Understanding the child adoption laws in Pennsylvania can greatly increase your chances of successfully adopting a child. Important legal concerns include the giving of support or gifts to a birth mother or birth father, fees paid to an adoption agency, attorney, or other intermediary, the legality of using an adoption facilitator, the legal rights of the birth parents and the adopting family, and the critical issues of a disruption and the ending the biological parental rights (called a Consent, Relinquishment or Surrender). For example, using our most recent update, in Pennsylvania: *Birth parent expenses that are allowed include medical and hospital costs, foster care expenses, adjustment counseling, and training services. *The intermediary's written report to the court shall include an itemized accounting of all monies paid, agreed to be paid, or received in connection with the adoption. *No consent shall be valid if it was executed prior to or within 72 hours after the birth of the child. A putative father may execute consent at any time after receiving notice of the expected or actual birth of the child. *Revocation of Consent: The consent is irrevocable more than 30 days after the birth of the child or the execution of the consent, whichever occurs later. *Rights of Presumed (Putative) Fathers: At least 10 days notice of a termination proceeding shall be given to the putative father if he has filed a claim of paternity prior to the institution of proceedings. |
